Frightening Draft Executive Order Targets Refugees Worldwide and Muslim Immigrants

by Kelly Rojas, Esq.

Today a frightening new draft Executive Order from the Trump administration was leaked to the public. The proposed order is an assault on immigrants and refugees worldwide, but particularly targets people of the Muslim faith.  CAIR Coalition is alarmed by this proposed assault on immigrant and human rights.

The immigrant groups targeted by the draft order include:
  • All immigrants and other travelers from several Muslim-majority countries.  Key points from the order:
    • Bans all people from designated countries from entry to the U.S. for 30 days under any type of visa -- an immigrant (green card) visa or a non-immigration (tourist, temporary employment, crime victim, etc.) visa
    • Claims that this ban is necessary to prevent the "infiltration" of terrorists or criminals
    • Allows exceptions only if the person's admission is deemed to serve the national interest
    • Is reported to include people from Iraq, Iran, Libya, Somalia, Sudan, Syria, and possibly Afghanistan
  • Refugees.  Key points:
    • Stops the admission of refugees from all parts of the world for 120 days
    • Indefinitely suspends the admission of refugees fleeing Syria
    • Permits the Executive to ban the admission of refugees from additional countries beyond 120 days
    • Allows individual exceptions only if the person's admission is deemed to serve the national interest or the person is a member of a religious minority
    • Prioritizes the admission of refugees who are religious minorities over refugees who face harm and death for other legally protected reasons
  • All non-U.S. citizens worldwide seeking entry to the U.S.  Key points:
    • Contemplates the Executive banning all admissions of persons from additional countries that do not comply with U.S. information-sharing demands
    • Suspends the Visa Waiver Program, a program that allows persons from a number of wealthier, mostly European countries to visit the U.S. without first interviewing for a visa at a U.S. consulate abroad
