In this interactive training, designed for those doing significant U visa work,  national and local experts will identify and discuss with participants hot topics in U visas,  safety planning to avoid survivor removal, expanding your work with community organizers and others who can help challenge attempts to remove survivors, arguments on challenging removability designed for survivors, learning to do administrative stays, and identifying the steps for filing habeas/TROs to stop survivor removal when these efforts have failed.

Panels:

  • Interactive Case Rounds: In this interactive exercise, participants will be able to strategize on complex scenarios that may arise in U visa cases, including framing a U visa case, addressing problems that arise after filing, preparing a case for U adjustment, and creative ways to handle back-logged cases.
  • Hot Topics: This panel will discuss emerging practices for addressing adjudication trends in U visas, including framing and responding to RFEs and denials of the 212(d)(14) national and public interest inadmissibility waiver, flagging and fixing reinstatement and failure to voluntarily depart, and creative strategies for U visa applicants in detention and/or removal.
  • Overview: Protecting Clients Against Removal This panel will discuss how to protect your survivor clients in the new enforcement atmosphere, including practical tips on immigration safety planning with survivors, using political and community organizing strategies to help advance and protect the rights of your U visa applicants, and advocacy strategies with DHS to hinder U applicant removals.
  • Skills Building to Prevent Removal:  What, When, How? In this panel experts will discuss details of how to identify and plan for filing stays of removal and potential federal court habeas/TRO actions to prevent removal.
  • Applying the Skills:  What to do when removal threatens?

Participants will divide into small working groups and strategize on the preparation of stays of removal, habeas/TRO petitions, and other action plans for preventing removal.
