Court Blocks Illegal “Death to Asylum” Trump Rule

San Francisco, California (January 8, 2021) - Today the U.S. District Court for the Northern District of California issued a preliminary injunction blocking a sweeping Trump administration rule that would gut protections for people fleeing persecution and torture. The injunction halts the new rule’s implementation nationwide ahead of its scheduled effective date of Monday, January 11, while the court considers a lawsuit brought by several immigrant rights groups.

The case, Pangea Legal Services II v. Barr, was filed by organizational plaintiffs Pangea Legal Services, Dolores Street Community Services, Inc., Catholic Legal Immigration Network, Inc. (CLINIC), and Capital Area Immigrants’ Rights Coalition following the rule’s publication in December. The groups are represented by the Center for Gender & Refugee Studies, the Harvard Immigration and Refugee Clinical Program, and Sidley Austin LLP.

The rule at issue was signed by Chad Wolf, who has been filling the role of Acting Secretary of the Department of Homeland Security since November 2019. Today’s ruling from U.S. District Judge James Donato builds on multiple court decisions finding that Wolf lacks the legal authority to head his agency and promulgate regulations, and that this requires nullification of the rule.

“This monstrosity of a rule would erect nearly insurmountable obstacles to protection for people fleeing life-threatening violence,” said Jamie Crook, Director of Litigation at the Center for Gender & Refugee Studies, who argued the case on Thursday. “We are grateful that the court has taken swift action to stop this dangerous rule from taking effect – and placing courageous refugees in harm’s way.”

“This is the most far-reaching of the midnight asylum regulations unveiled in the Trump administration’s final days,” said Sabrineh Ardalan, Director of the Harvard Immigration and Refugee Clinical Program. “But try as it may, this administration cannot destroy our asylum system and rewrite our laws by executive fiat. We are confident that this rule will ultimately be struck down for good.”

Today’s ruling also applies to the related case Immigration Equality et al. v. U.S. Department of Homeland Security, argued by Omar Gonzalez-Pagan on Thursday.

 

Corte bloquea regulación ilegal “Muerte al Asilo” del gobierno Trump

San Francisco, CA (8 de enero de 2021) – El día de hoy la Corte Distrital para el Distrito del Norte de California emitió una orden preliminar bloqueando la devastadora regulación del gobierno Trump que hubiera destruido el acceso a protecciones para quienes huyen de la persecución y la tortura. Gracias a la orden, la nueva regulación no se implementará a partir del 11 de enero, como estaba programado, y en cambio su implementación se suspenderá mientras la corte analiza la demanda presentada por varias organizaciones que defienden los derechos de los inmigrantes. 

La demanda en el caso Pangea Legal Services II vs. Barr fue presentada por Pangea Legal Services, Dolores Street Community Services, Inc., Catholic Legal Immigration Network, Inc. (CLINIC), y Capital Area Immigrants Rights Coalition, luego de la publicación de la regulación en diciembre. Estos grupos son representados por el Centro de Estudios de Género y Refugiados (CGRS, por sus siglas en inglés), el Programa de la Clínica Jurídica de Inmigración y Refugiados de la Universidad de Harvard, y el bufete de abogados Sidley Austin, LLP. 

La regulación fue promulgada por Chad Wolf, quien ha estado ocupando el cargo de secretario encargado del Departamento de Seguridad Nacional desde noviembre de 2019. La decisión del juez federal James Donato se suma a las decisiones de múltiples cortes que han encontrado que Wolf carece de autoridad legal para dirigir su agencia y promulgar regulaciones, y que por tanto esto requiere la nulificación de la regulación. 

“Esta monstruosa regulación hubiera erigido obstáculos casi imposibles de superar para las personas que buscan protección y que huyen por sus vidas”, dijo Jamie Crook, directora de litigio en el Centro de Estudios de Género y Refugiados, quien presentó argumentos orales en el caso este jueves. “Estamos agradecidas que la corte haya actuado de manera inmediata para detener la implementación de esta peligrosa regulación, la cual pone a los refugiados en riesgo”. 

“De todas las regulaciones publicadas por el gobierno Trump en el ocaso de su administración, esta es quizás la de más largo alcance”, dijo Sabrineh Ardalan, directora del Programa de la Clínica Jurídica de Inmigración y Refugiados de la Universidad de Harvard. “Pero por mucho que lo intenten, este gobierno no puede destruir nuestro sistema de asilo y reescribir nuestras leyes a través de mandatos ejecutivos. Confiamos que, en últimas, esta regulación será anulada del todo”. 

La regulación de hoy también aplica para el caso relacionado conocido como Immigration Equality et al. v. U.S. Department of Homeland Security, el cual también fue argumentado por el abogado Omar González-Pagan el día jueves.
